TripDM Conditions of Use & Sale

These Conditions of Use & Sale govern access to and use of the TripDM platform. By using TripDM, you agree to these Conditions, the Privacy Policy, and the Internet-Based Policy.

1. Marketplace Disclaimer

TripDM is an online marketplace that connects Travelers with independent Travel Agents (Vendors). TripDM is not a travel agency, tour operator, hotel, airline, transport provider, visa consultant, or insurer. Any booking, agreement, payment, or travel arrangement is solely between the Traveler and the Vendor.

2. User Terms

Users must provide accurate information, use the platform lawfully, maintain account security, communicate respectfully, and verify vendor information before making payments or entering agreements.

3. Vendor Terms

Vendors are responsible for the accuracy of listings, pricing, licenses, taxes, bookings, customer service, refunds, legal compliance, and fulfillment of services. Vendors must not misrepresent travel products or engage in fraudulent practices.

4. Lead Credit Policy

TripDM operates on a lead-credit model. Credits are deducted when a new qualified customer conversation is initiated with a Vendor. Credits are generally non-refundable except where required by law or expressly approved by TripDM. Promotional credits may have separate terms.

5. Booking Policy

TripDM does not confirm or guarantee bookings. Booking terms, availability, pricing, and confirmations are managed exclusively by the Vendor.

6. Payment Terms

Travelers pay Vendors directly. TripDM does not collect or process traveler payments for travel services. Vendors are responsible for invoices, taxes, refunds, and payment receipts. Payments made to TripDM, if any, relate only to Vendor subscriptions, advertising, or lead credits.

7. Refund & Cancellation

Refunds and cancellations for travel services are governed by the Vendor's policies. TripDM is not responsible for refund decisions arising from transactions between Travelers and Vendors.

8. Limitation of Liability

To the fullest extent permitted by law, TripDM shall not be liable for losses arising from Vendor services, travel disruptions, cancellations, payment disputes, injuries, property damage, visa refusals, or any agreement between Travelers and Vendors.

9. Travel Risks

Travel involves inherent risks including weather, natural disasters, political events, transport delays, illness, accidents, and regulatory changes. Travelers assume these risks and are encouraged to obtain travel insurance.

10. Force Majeure

TripDM shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, strikes, epidemics, internet outages, cyberattacks, or government actions.

11. Governing Law

These Conditions shall be governed by the laws of India. Courts having jurisdiction over TripDM's registered office shall have jurisdiction, subject to applicable law.

12. Dispute Resolution

TripDM is not a party to disputes between Travelers and Vendors. Parties should first attempt amicable resolution. TripDM may facilitate communication but is not obligated to arbitrate or resolve disputes.

13. Indemnity

Users and Vendors agree to indemnify and hold harmless TripDM, its directors, employees, and affiliates against claims, losses, liabilities, costs, and expenses arising from their use of the Platform, violation of these Conditions, or infringement of third-party rights.
